The reason this step exists is simple: remediation can look successful and still fail. Visible mold can be removed while spores remain embedded in porous materials, moisture can linger behind a wall that was “dried” too quickly, or containment during the work can be less effective than it should be, spreading spores into unaffected rooms. Without lab-verified sampling, there’s no way to know which of those happened. You’re taking the remediator’s word for it.
Does Florida law require an independent inspector for clearance testing?
In many cases, yes, and this is where a lot of homeowners get caught off guard. Under Florida Statute § 468.8419, a mold assessor who evaluated your property cannot also perform the remediation on that same job. Just as importantly, a mold remediator who performed the remediation cannot turn around and perform the mold assessment, including clearance testing, on that same property within 12 months. The law exists specifically to prevent one company from grading its own work: the same business that profits from remediation shouldn’t be the one certifying that the remediation succeeded.
In practice, this means if your remediation company is the one telling you the space is “clear,” that determination may not meet the independence standard Florida law is built around, and it’s certainly not the objective, third-party confirmation you’d want before moving your family back into a room or closing out an insurance claim.

What if the clearance test doesn’t pass?
